Terms and conditions
Terms and conditions are between Mobipunkt OÜ (seller) and Mobipunkt OÜ client (Buyer).
Seller has right to change in Website whatever changes in information and prices without notice.
Seller has the right to change terms and conditions without notice.
Buying an item the Buyer confirms that he/she accepts terms and conditions.
All prices in web shop are with VAT (20%). Exceptions are the items for which a 0% VAT rate (KMS § 41.), which has been shown each corresponding product specification.
Seller has the right to change prices in web site without notice. If prices were changed after making an order and paying for items, the seller must sell the buyer items on that price that was before the changing. Seller has right no to sell items if the wrong price was inserted by mistake.
3. Ordering the items
If Buyer is certain, that he/she wants to buy an item, the buyer can put it in the shopping basket and make the order. After making an order the buyer receive an invoice via e-mail and after paying it, Seller start to deal with Your order.
Buyer can pay for the items:
1) via Bank transfer
2) Cash on Payment/Card Payment in Mobipunkt store
Buyer must give the seller true information in the order. Seller is not responsible for mistakes made by giving the seller wrong information.
If the Buyer received the invoice via e-mail and not paid for it in 2 days, the order will be canceled.
Photos of items are illustrative in web site and may be differ from the real item.
The agreement between Buyer and Seller is made after Seller receives the money for items shown on the invoice.
All Buyer information collected by Seller is confidential and Seller is not sharing it with 3rd parties (except couriers who need some information like address for delivery). Mobipunkt has right to use Buyer contact details for sending the newstellers or offers.
4. Delivery time
If ordered items are in stock, delivery time is 1-5 working days after we receive payment. For getting items faster You can always pick them up in Tallinn form our assistant.
If ordered items are in distributor stock, delivery time is 3-7 working days after we receive payment.
If ordered items are not in stock, we arrange delivery time with our client.
The fastest way to get items is to arrange meeting in our office in Tallinn (Roo 4, 10611, Tallinn).
Buyer can choose between different ways of receiving items:
• SmartPOST packing automats – price 2-4€
• Pick them up (in our office in Tallinn) – FREE (You can also pay when pick the items up)
Seller is not responsible for the loss or late delivery if the loss or late delivery could be affected by Seller.
5. Returning the items
Private person Buyer has the right to return the item in 14 days from purchase date made from webshop.
Client is responsible for the compensating value of the device worth loss if the goods have been used otherwise as it is normally allowed to do in a shop to check the goods function. Goods that are not eligible for return for health or hygienic reasons and are open after delivery cannot be returned. It is also not possible to return audio and video recordings or computer software with open covers.
For returning the items the buyer should write the Seller an e-mail with invoice number to firstname.lastname@example.org in 14 days after the purchase date. The buyer has the right to cancel an order before making a payment sending an email: email@example.com
The seller return all charges received from the buyer under the contract, including the costs of delivery without delay, but not later than 14 days after the receiving goods back. If the ordered goods do not match the order, the costs of the exchange and return are paid by the Seller. Money for returned goods will be returned as soon as possible but not later than within 14 days.
Private person Buyer has the right to make a claim within 2 years revealed non-compliance with the terms of the contract, if the defect occurred within the first 6 months, it is assumed that it was present at the time of purchase, and nature of the defect has to identify the seller. After the six-month period the Buyer must pay for the costs of identify the defect.
Mobipunkt is not responsible for the defects that:
Commissioned by the fault or neglect of the damage to the product (mechanical, water damage, electrical damage) ;
Product use in not normal conditions (like to hot or too low temperature);
Product natural physical wear during normal use.
Buyer must send an e-mail (firstname.lastname@example.org) if the item got a defect with Buyers name, invoice number and description of defect.
7. Other terms
Seller is not responsible for loss that was made by defective item (loss of margin, moral damages and so on)
In these conditions and in not regulated cases Buyer and Seller follow the rules of The Republic of Estonia. In case of disagreement the parties to attempt to reach an agreement through negotiations. If parties are unable to resolve a contractual dispute, both Buyer and Seller has the right go to the court or Tarbjakaitseamet.
